DRENCH FORCE MANIA – TERMS AND CONDITIONS OF RENTAL

Welcome to Drench Force Mania! We're thrilled to provide you with high-energy, interactive water entertainment. To ensure a safe and enjoyable experience for everyone, please read and understand these Terms and Conditions carefully before renting any equipment from us. By proceeding with a rental, you, the Renter, agree to be bound by these terms.
1. Definitions
"Company," "We," "Us," "Our": Refers to Drench Force Mania.
"Renter," "You," "Your": Refers to the individual, organization, or entity renting equipment from Drench Force Mania.
"Equipment": Refers to all items rented from Drench Force Mania, including but not limited to water guns (automatic, soakers, smaller models), foam machines, foam solution, water tag arenas, water mazes, dunk tanks, balloon launchers, cornhole sets, safety goggles, vests, and any other accessories or items provided for rental.
"Rental Period": The agreed-upon duration for which the Equipment is rented, as specified in your booking confirmation.
2. Rental Agreement
Booking and Payment: All rentals require a confirmed booking and payment as per our agreed-upon package and pricing. A deposit may be required to secure your reservation. Full payment is typically due prior to or upon delivery/pickup of the Equipment.
Rental Period: The Equipment is rented for the specific Rental Period agreed upon. Late returns may incur additional charges.
Delivery and Pickup: We will arrange for the delivery and/or pickup of the Equipment as specified in your booking. It is the Renter's responsibility to ensure clear access to the delivery/pickup location and to be present at the agreed times.
3. Use of Equipment
Proper Use: The Equipment must be used only for its intended purpose as water-based recreational entertainment. Any misuse, abuse, or unauthorized modification of the Equipment is strictly prohibited.
Safety Guidelines:
Eye Protection: Safety goggles are provided with rentals and must be worn by all participants during active water gun play.
No Shooting at Faces: Participants must never intentionally aim water guns at anyone's face or eyes.
Supervision: All activities involving the Equipment, especially those with children, must be supervised by a responsible adult at all times.
Clear Play Area: Ensure the play area is clear of hazards, has adequate drainage, and is free from slippery surfaces.
Foam Pit Safety: Follow all instructions provided for foam pit use, including avoiding slipping and ensuring adequate ventilation.
Dunk Tank Safety: Adhere to all safety instructions for dunk tank operation, including proper seating, safe throwing distance, and ensuring the person being dunked can swim.
Prohibited Uses:
Using the Equipment with anything other than clean, potable water.
Using the Equipment in or near electrical outlets or devices.
Climbing on or misusing inflatable structures.
Operating Equipment in unsafe weather conditions (e.g., thunderstorms, high winds).
4. Renter's Responsibilities
Inspection Upon Receipt: The Renter must inspect all Equipment upon receipt to ensure it is in good working order and free from damage. Any discrepancies or damage must be reported to Drench Force Mania immediately upon receipt. Failure to do so will result in the Renter being responsible for any pre-existing damage not reported.
Care and Maintenance: The Renter is responsible for the proper care, maintenance, and safe use of the Equipment during the entire Rental Period. This includes ensuring water guns are not left submerged, are kept free of dirt/debris, and are not exposed to extreme temperatures.
Return Condition: All Equipment must be returned in the same clean, dry, and functional condition as it was received, reasonable wear and tear excepted. Water guns should be emptied of water before return.
5. Damage, Loss, or Breakage of Equipment
The Renter is fully responsible for any damage to, or loss of, the Equipment, regardless of cause, from the time of delivery/pickup until its return to Drench Force Mania.
General Damage/Loss: For any Equipment (excluding water guns, which have a specific clause below) that is damaged beyond repair, lost, or stolen during the Rental Period, the Renter will be charged the full retail replacement cost of the item. For repairable damage, the Renter will be charged the cost of repair.
Specific Clause for Water Guns (Automatic, Soakers, Smaller Models):
If a water gun is returned broken, damaged beyond reasonable wear and tear, or is not returned at all (lost or stolen), the Renter will be charged a replacement fee.
"Broken" is defined as any damage that renders the water gun non-functional or significantly impairs its intended use, including but not limited to cracks in the casing, broken triggers, non-functioning pumps/motors, significant leaks, or missing essential parts.
The replacement fee for a broken, lost, or stolen water gun will be the current retail price of that specific water gun model PLUS an additional 25% over the retail price. This additional 25% covers administrative costs, loss of rental income during replacement, and the expedited acquisition of new inventory.
Example: If a specific automatic water gun model has a retail price of $100, the replacement fee charged to the Renter will be $100 + ($100 * 0.25) = $125.
Reporting Damage: Any damage, loss, or breakage must be reported to Drench Force Mania immediately upon discovery.
6. Liability
Company's Liability: Drench Force Mania is not responsible for any injuries, damages, or losses incurred by the Renter or any third party arising from the use or misuse of the Equipment. The Renter acknowledges and accepts all risks associated with the use of the Equipment.
Renter's Indemnification: The Renter agrees to indemnify, defend, and hold harmless Drench Force Mania, its owners, employees, and agents from and against any and all claims, liabilities, damages, costs, and expenses (including legal fees) arising from or related to the Renter's use, possession, or operation of the Equipment, including any claims for personal injury or property damage.
7. Cancellation Policy
Renter Cancellation:
Company Cancellation: Drench Force Mania reserves the right to cancel a rental due to unforeseen circumstances (e.g., severe weather, equipment malfunction, safety concerns). In such cases, a full refund or rescheduling will be offered.
8. Dispute Resolution
Any disputes arising under these Terms and Conditions shall first be attempted to be resolved through good-faith negotiation.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Nebraska.
10. Acceptance of Terms
By confirming your booking and/or taking possession of the Equipment, you acknowledge that you have read, understood, and agree to all the Terms and Conditions set forth herein.
